When buying the tour: The passenger is notified of the present general conditions, and should accept them in a direct and automatic way. The present agreement and in turn the presentation of services will be ruled exclusively by these general conditions and by law 18,829 and its regulation and by the Brussels Convention by law 19,918. The present general conditions together with the documentation received by the passenger will make up the travel agreement established by the above mentioned convention.
Arbitrage Clause:
Personal documentation: All passengers are responsible for having their personal documentation in order prior to the trip. Klenkes S.R.L. declines any responsibility caused by insufficient, invalid or no documentation. For foreign passengers it is necessary to comply with the legislation in force in each case.
Under-aged passengers: All passengers under 21 years old will be irrefutably authorized by their parents, tutors or people in charge before making the trip.
Responsibility: Klenkes S.R.L. explicitly states that it acts solely as intermediary between the passengers and the service providers. As such, it declines all responsibility for inefficient services, as well as for accidents and their consequences, deterioration, loss and/or partial and/or total robbery of baggage and/or personal belongings, events derived from government decisions, strikes, terror acts, natural disasters, etc..
Limitations to the right of permanence: Klenkes S.R.L. reserves the right to decide that any passenger whose behavior, way of acting, health condition or other serious reasons that, in the company’s opinion, may cause danger or disturb the other passengers or the tour itself, should abandon the tour at any point.
Prices include: Solely and exclusively the services indicated in the trip itinerary. Any other service will be charged to the passengers. Accommodation for the number of nights specified and mentioned in the itinerary, in specified hotels or others of similar or higher category with the meals plans indicated. The same will be for transfers to and from the Terminal, as indicated. Regarding hotel rooms, they will be allocated upon passengers’ arrival in total accordance with the ones booked and specified, depending on availability upon check-in. Any change of category in the room assigned will be paid by the passenger. In case of hiring optional excursions, they will be at the passenger’s responsibility and risk at the moment of hiring them, with no responsibility by Klenkes S.R.L. nor for their fulfillment, nor for the amount paid, since it is clear that it is alien to the services acquired and/or agreed.
Registration and payment: The registration for the trip will be made after a down payment of thirty per cent (30%) of the total price. The balance payment will be made with a minimum of ten (10) days prior to the departure date.
Trip modifications or alterations: Klenkes S.R.L. reserves the right to make partial and/or total modifications to the trip itinerary and/or alterations with respect to the services agreed, in the event of fortuitous circumstances or unforeseen causes, in order to develop the most successful activities scheduled. Except for conditions expressed otherwise, hotels can be changed for others of similar or higher category within the same urban area, with no surcharge on the passengers’ part. Passengers will not be entitled to any indemnification.
Baggage: Passengers are in custody of their baggage at all times, bearing in mind each service provider’s conditions and modalities during transfers. Klenkes S.R.L. will not be responsible for baggage loss or damage.
Cancellations: All requests for trip cancellation or refund of amounts paid by passengers will be made in writing. No refunds will be made for any cause before the balance is paid. The refunds that will be made are the following: up to 22 days prior to departure, 70 %, from 21 to 14 days, 60 %, from 14 to 7 days, 50 % and, within 7 days, no refund will be allowed. The percentages of the money refunded are calculated over all the trip. Moreover, it is established that:
- No refund will be made for those services cancelled voluntarily by passengers, no matter the cause.
- Those passengers who do not show up in due time upon departure will lose the right to any claim.
Agreement: The present Terms and General Conditions are given to each passenger when making the reservation of services (or requesting the registration), making a copy for the company. The payment of the reservation implies the acceptance on the passengers’ part of the whole application of the present terms and general conditions, the special conditions of each service hired, as well as of the conditions stated by the service providers. Passengers will in no way state that they ignore such conditions.
Acknowledgement and acceptance of general conditions: The registration of the trip implies the acknowledgement and acceptance of the above mentioned general conditions.
